My solicitor has advised me that I need to appoint a fiscal representative to pay my annual wealth tax. He is prepared to carry out these duties for 180euros a year. Does this representative need any proffesional qualifications or could anyone do it and is 180euros a bit steep?

Hi Hanzando.
You are only 'required' to use a fiscal representative for your wealth tax if you own more than one property. Have a look through for the recent thread on wealth tax which explains how you can do it yourself and save the money that your solicitor is clearly trying to weasle out of you!

What exactly does the fiscal representative do for the money? Is it easy to do yourself? Or is the representative like a notary in the sense that they are authenticating your tax liability.
Does anyone on the forum do their own tax declaration?

I guess some people are happy to pay for the convenience of not having to worry about it. Completing your tax return is not difficult, allows you an insight into the Spanish way of life, lets you practice your Spanish on real people, and saves you money. Most people's tax is probably less than they are being charged by their fiscal representative, so you're effectively more than doubling your costs!
As for IBI, if you live on a newly completed Urbanisation it's unlikely that you'll have to pay for the first two or three years anyway, as it takes that long for the authorities to set the Cadastral Values for the properties. Once this value has been set all you have to do is to go to the Suma office and set up a direct debit which will then automatically pay your IBI for you each year.

Doc,
You missed the point. It is handy having a fiscal representive especially if you live in the UK. Someone once owed me some cash a few years ago so I letter from my fiscal dropped on their letterbox. The next day they went to my bank to pay up. I take your points about saving cash and doing it yourself.

Tax
If you feel happy paying 80-180 euros (which is a big contrast and just proves to me it is money for old rope) then that is fine - it took me 10 mins to fill in the forms and a nice 15 min walk to the bank and 10 mins in the bank job done - there is of course an initial trip to the Agencia in Orihuela to get the forms/envelopes/stickers - each to their own

The whole concept of a wealth tax or implied rent for non residents has been challenged in the European Court as discriminatory. We are all part of the same European Community and other countries do not discriminate against non-nationals in this way. If this challenge is successful then other EC national must be tried in the same way as the indigineous Spanish population. This will have implications for capital gains tax as I believe that non-nationals are treated differently for this tax.

PaddyW,
Interesting email from you. If this happened you would be popular. Have you followed it up anywhere (e.g. Spanish Embassy, newspapers, etc). I do not think I would invest any more money in Spain. Withdrew all the savings I had in Spain. They are fleecing the people who are keeping them from being a third world country again. Look at the massive investment from Northern Europeans into some parts that were little more than a desert ten years ago (e.g. southern Costa Blanca). If you sell a property as a non-resident there is 35% capital gains tax to pay. I will probably just keep my property as a holiday home.
Enough is enough.
