  • Form E121

I am moving over their this year (as anyone who reads my posts will know) can't wait.

I have emailed my solicitor about residencia and she has informed me that I need to obtain a Form E121 from Newcastle DHS, I have no problem with doing that, my question is what is then the consequences of doing this.
Does it mean I have to re-register here if I want to come back?

What happens to my NI contributions I have paid into in the UK?

What if I chose to come back here for some medical treatment , would I still be able to get it?

Also I am confused the form E121 is for pensioners, people who are working legally in Spain, people on disability, or people who are unable to work.
I will not fall into any of these catagories. I am coming to Spain but will be supported financially by my husband in the UK.

Any pointers would be helpful, anyone else with similar situation what have you done? Are you resident or visiting?

Thanks in advance for any info.

I am amazed that you have been told this info as i was also told this but as i speak to more and more people they do not realise they can do this.

Anyway we did this which is a great help this form you can fill in over the phone if you ring Newcastle.the form is used to transfer your ni credits to the spanish system allowing you to use the services over here free of charge the length of time depends on how many credits you have gaines the maximum is two and a half years. If you go back to the uk you will have to re register i think but am not sure. The credits are no good to you in the uk you may as well bring them to spain and use what is yours.
You can not use the e111 as it is seen as fraud once you have moved out of the uk permanently

If you do not get your credits transferred before you come over it can cause a lot of hassle including having to pay private medical we paid 160 euros a month til we sorted it, or you can go to private doctors and pay 40 euros per visit plus any medication costs so my advice is forget having to re register if you go back to the uk this is the least of your worries.

I am still totally confused by the subject. I maybe thick, but I thought only pensioners and workers and who were residents of Spain could use the Spanish National Health system. Is this not the case? You also talk about transferring your NI contributions. I plan to still pay voluntary NI contributions into the UK when I move to Spain so that I can still get an OAP pension. If my contributions get transferred to Spain, what will happen to my Pension rights? Does anybody know?

we are not retired and sorry about the confusion but our form is the e106. If you phone the office at nottingham and explain the situation they will advise you as they did me. the phone number is 01912181999 if you are paying national insurance contributions then you can use the e111. and no you do nat have to be a resident in spain, if you have property over here you will get an nie number and if you are staying for six months or more you will need to get a padron, all this sounds complicated but is quite straight forward and we did this without help we do not speak spanish, we live at Playa Flamenca and did this at the local town hall if you want any more info get in touch info@holitots.com and i will give you my phone number to contact me on we can then chat

Are you saying that actually you do not need to be a resident to live in Spain for more than 6 months?

Because this is contrary to everything I have read and been advised?

The form E106 is only temporary and is only valid for a maximum of 2 years whilst trying to find work in Spain after that you cannot apply for it to be extended. The E121 and the E106 are regarded as permenant: in other words you transfer your health provision from the UK to Spain. This means that you are still eligable for cover in the UK but only as a visitor.

          Confused I am!!!!!!!!!!!!!!!!!!!!!!

I will give Newcastle a call and get some clarification on this I think.

We have lived and worked here for almost three years, and as we are legally registered here and pay our monthly social payments, we are entitled to use the Spanish health system. We have been informed that we only need to apply for residecia if we ever want to sell our house, as we would pay less tax to the government if we have residencia! (or something like that). It was in the paper recently that they may be phasing out the need for them in the next few years, but we shall see... I think it is currently taking people 12 months ish to sort out residencias from start to finish!

As you say, E121 is for people in receipt of state pensions. E106 if for people who've worked in UK prior to moving and if entitled, lasts for for a limited period. Ask Newcastle about E105, as this might be of use in the event of entitlement to any future cash benefits by virtue of husband's employment/NI payments in UK. I don't think this extends to state health care, either in UK or Spain, unless you can get a SIP card by virtue of being resident in Valencia Community and being in a situation of having no access to health care. Seems UK NHS can charge a spouse who is not living in the UK with husband/wife as could be that the spouse would be considered not ordinarily resident. As for EHIC (E111 replacement), maybe you wouldn't be entitled to that from Spain or UK either, if you become resident in Spain without entitlement to state health care, because you are not insured there. So looks like private medical insurance for Spain and travel insurance for when you go on holiday elsewhere in Europe or UK. If this is the case, what a joke!
