  • breaking community rules - what happens?

Posted: Fri Jul 21, 2006 1:36 pm Post subject:
    --------------------------------------------------------------------------------

I have put this post also on the legal forum but I wanted here some "shop floor" answers.

if a person breaches community rules, what sanctions can be imposed?

can the Spanish govt impose any penalties on the community? or is the enforecement of rules totally in the hands of the community?

reason I ask - in the pool the other day and committee member advised a guest that the community would be in trouble from the Spanish govt if the guest failed to comply with the pool rules. is this correct?

    Hi Lizzy.

I don't know the exact answer to your question but feel it extremely unlikely that the government would get involved in community matters (whether they had jurisdiction to do so or not).

It largely depends on what the breach is. Communities are run by the rules of the Horizontal Property Law - a good book to look at is
You and the Law in Spain by David Searle
    .

If you want to look at a translation of this law then follow this link:

HTH, if not then post more details and I'll dig around for you!

    Chris.

      breach of community rules

I am talking here solely about the community rules set up by the community, not about the set up OF the community - it this makes sense. our community is set up OK and being run OK by administrator and committee.
rules have been set but some, being a tad unreasonable, are being broken by members.
eg you can't take a buggy into the pool area - so how do you get the baby in and where do you put it once it's there (there is no grass!).

when committee member approached parent because rule was being broken, they said that any breach of the rules would result in repercussions from Spanish govt.

I personally thought this was ludicrous. we have a meeting in sept and I want to raise this but want to be on firm ground.
