  • Just another quick note, just been looking at the guardia civil website, and there is footage and photos of the guardia civil in the telmicro offices...
    also with, reasons to why they have been closed down...looks like the owners are in big trouble....

      OOhhhhh, I can't see why the others aren't being shut down in exactly the same way, also it doesn't mention tax fraud, just the illegal broadcasting.
      That's definitely the end of Telmicro then I would say. Oh well, good whilst it lasted.

          As I said in the other forum, digi boxes, tv screens, sat dishes and adapters bet that was a real shock for them!!! As far as I can see it is all stuff we already knew, thankful for the confirmation that Canal started all this, also the business was owned by mostly Spanish!!! I for one knew their was piracy involved and that my CASH fees were not going through the books, as has been said by others this would be exactly the same for all the other broadcasters, difference is they have had some warning to to avoid the same fate as the largest re-broadcasters. Any way will wait for confirmatin from TM whether they will continue.

            I´m not so sure - would you walk away from a 12million Euro a year income?

              Se estima que la organización ha podido defraudar más de 500 millones de euros

              Han sido detenidos 14 integrantes de la red, ocho españoles, tres británicos, un bielorruso, un rumano y un ruso, que captaban la señal de canales británicos y los emitían en la costa levantina desde Alicante hasta Almería para clientes del Reino Unido, sin pagar los derechos correspondientes y sin declarar los beneficios a la Hacienda Pública

              En los 22 registros practicados se han incautado equipos informáticos, material técnico de recepción y emisión de televisión, decodificadores, mezcladores y dinero en metálico por valor de más de 5 millones de euros

              La Guardia Civil en la denominada operación “CIMITARRA”, llevada a cabo en las provincias de Alicante, Murcia y Almería, ha desmantelado una red internacional dedicada a emitir fraudulentamente canales privados de televisión para clientes de origen británico con domicilio en la costa de las citadas provincias.

              Se estima que el fraude que han podido cometer tanto a las plataformas de televisión como a la Hacienda Pública, podría superar los 500 millones de euros.

              En la operación han sido detenidos 14 integrantes de la red y se han llevado a cabo 22 registros en los que se han incautado equipos informáticos, material técnico de recepción y emisión de televisión, decodificadores, mezcladores y dinero en metálico por valor de más de 5 millones de euros.

              La organización operaba de forma encubierta empleando tres empresas con cobertura legal. Adquirían los derechos de emisión de varios canales del Reino Unido para la distribución de la señal a suscriptores en territorio británico.

              La red desarticulada declaraba un número muy inferior de suscriptores a los que realmente tenía y además distribuía ilegalmente la señal en territorio español,, sin disponer de los derechos para ello.

              Las investigaciones se iniciaron a raíz de la denuncia presentada por un representante legal de Sogecable, tras detectar que determinadas emisiones de canales británicos en Alicante incluían contenidos cuya titularidad de los derechos audiovisuales en nuestro país correspondía en exclusiva a dicha plataforma digital.

              Tras investigar la infraestructura utilizada por la organización, se pudo comprobar que en una nave situada en un polígono industrial de Algorfa (Alicante) disponían de potentes antenas parabólicas y decodificadores, contratados en Reino Unido e Irlanda.

              Estos medios técnicos permitían captar la señal de varias cadenas británicas de televisión por satélite, las descodificaban y volvían a codificar utilizando un sistema denominado IRDETO, para posteriormente distribuirla a sus clientes de toda la costa desde Benidorm hasta la localidad de Vera (Almería) a través de una red de emisores y repetidores propios.

              Más de 60.000 clientes que pagaban 22 euros mensuales

              La trama disponía de más de 60.000 clientes, en su mayoría miembros de la comunidad británica afincados en el Levante español, que pagaban 590€ por gastos de instalación, más las cuotas mensuales de entre 18 y 22 euros, o bien, cuotas anuales de entre 200 y 220 euros, dependiendo de los canales contratados.

              La instalación en el domicilio de los clientes consistía en una antena específica para las frecuencias de emisión utilizadas y un aparato decodificador que únicamente funcionaba con una tarjeta con numeración única para cada cliente, lo cual hacía posible cortar la señal en caso de falta de pago.

              Algunos canales de televisión habían dado autorización para facilitar la señal a un número limitado de clientes, cobrando los derechos correspondientes, compromiso éste que incumplía la red desarticulada ya que el número real de clientes era muy superior al realmente declarado por la organización.

              Del mismo modo, defraudaban a la Hacienda Pública, ya que declaraban las ganancias correspondientes a unos 17.000 clientes, en lugar de los 60.000 con los que contaban.

              Detenidos

              - Españoles: A.O.M., de 59 años; I.O.M. de 30; D.L.M.E., de 59; F.J.P.Q., de 33; G.G.P., de 28; J.R.M., de 34; J.A.S.G., de 35; A.J.S., de 29 años.

              - Británicos: P.G.W., de 37 años; R.E.I.G., de 52; y R.G.W., de 54.

              - Bieloruso: Y.S., de 43 años.

              - Rumano: F.M.P., de 35.

              - Ruso: A.Z., de 54 años.

              Las investigaciones han sido llevadas a cabo por el Equipo de Policía Judicial de la Guardia Civil de Torrevieja (Alicante)

                  We will probably all be dead before it comes out, you know what Spain is like for court cases, bit like a Duracell battery, goes on and on and on........
                  I've given up and am going the Freesat route 2.4 dish.

                      • Those pesky sat channels

                        AFAIK, whilst everyone is picking up on re-broadcast etc of SKY - most if not all satellites channels are in the same situation as SKY quotes - that is, that for copyright-ish/legalistic/broadcasting rights reasons, any channel broadcast via satellite is LEGALLY only viewable within the country for which the signal is intended. In SKY's case that's only the UK or Ireland for Irish SKY, like it or not, that's why they'll switch you off if they find out!

                        So a Dutch channel broadcasting a movie in English with Dutch subtitles is not really LEGAL to view in Spain, even though you may well be able to receive same and watch it fine. That's because the original broadcaster (call it Holland tv) has ONLY paid for the rights to broadcast that film to Dutch people living in Holland. That doesn't cover a Brit watching it in English and putting up with sub titles, nor does it cover a Dutch person watching it in Spain - he's not an intended viewer by virtue of living in Spain, even though he may well be watching a Dutch channel in Dutch or with Dutch sub titles.

                        The difference is subtle, being able to receive something is no guarantee that it's legal for you to watch it! The whole secret is not to get caught - even freeview/freetoair is probably not 100% legal for the same reasons if you're watching it in Europe - has the original broadcaster paid for the rights to broadcast Europe wide? and if they haven't, then it's most likely not legal if you don't live and watch in the country of origin of the broadcaster involved.

                        • For those that misunderstand, the fraud is for failing to pay the likes of sky and failing to declare to Hacineda(Tax Man) tha they had 60,000 clients and not the 17,000 they declared, and this fraud was started when the owner was caught about 2 yrs ago for the same thing.

                          • I am bewildered as to why everyone seems shocked about an article which contains information we already knew, the only thing we didn't know was how much, the question is what will the courts decide as punishment and can TM recover!

                            • The only way they will recover is to set up a new company and buy the assets? from TM but any new provider will NOT be able to deliver the range of channels that TM did without having contracts with sky etc which would be at an extorsionate price making the whole scheme uneconomic

                              • Torresat girl came into the office yesterday in Quesada and gave us, what she thought was an excellent offer for ex tm clients.
                                Long list of channels was included (Sky was not one of them) She claimed that TM was shut solely on Taxfraud. When questioned, she couldnt give a straight answer. And she didnt sound very convincing when questioned about the rebroadcast license either. She just kept saying that we look after our customers....

                                Why do I get the feeling that they are just sneaking in and wanna do a killing before the party is over?
