    Today I have visited the new AMICS office in Torrevieja (The new agency set up by the Valencian Government to help foreigners with all issues relating to living in Spain) which is situated next to the Town Hall in the church plaza (it used to be the International Residents Office) and the helpful gentleman told me that now people living and padroned in Torrevieja can apply for their residents certificate (either as 1st timers or to replace expiring residents cards) in Torrevieja in the office located in Calle Maldonado (top end off Gypsy lane near the windmill) and do not have to go to Alicante. I gather it is also possible to make an appointment to save hours of queuing!

    This office also issues NIEs (but not the same day)

      Went to the office last week, they issue 40 tickets a day. Open at 9am. Don't know what time the Q starts or if there is one

          Hi Rob thanks for mail No I dont have mine as Im not fortunate enough to reside in Torre right now we just pop over whenever we can to enjoy our property and work very hard in the UK to be able to do this but one day we will eventually make the move as they say.In the meantime I just appreciate all the good advice given by our friends on this forum.

            Went there this morning, got there for 7.45am, got the last of the 40 tickets issued. It appeared that people who did not get a ticket waited until the last person issued with a ticket was served, then got seen to with no ticket.

            Chattered to a couple waiting for their lawyer who had made arrangemnets to see them there at 10.30am and were seen with no ticket. I was renewing my residencia, not sure why or the purpose of it and have to go back in ten days for it??

            So is it worth just turning up after 10.30????

              Just changing the topic slightly. Does anyone know if you have to have the residencia now to get the padron?

              Also has anyone registered with the tax office as a fiscal resident and what paperwork do you need? I have been told by one person no padron or residencia necessary and by another that they are? We do not work so it will be a nil tax return if we put one in anyway.

                As far as I know, the only place you need a Residencia to get a Padron is Orihuela. A strange unilateral decision they made last year.
                When you take out Residencia you will be expected to file a tax return the following year. When that is done you will become a fiscal resident. Presumably you have pensions or something to live on if you do not work. Unless they are government pensions they will be subject to Spanish tax instead of UK tax. I think this is correct but am happy to be corrected.

                  We didnt want to bother doing the residencia if we dont have to just to become fiscally resident. Its only because we will be opening an off-shore bank account who will notify the spanish tax people rather than hold back 20% tax. Otherwise we may go back to the UK in a year or two so its a bit of a kerfuffle to bother doing it just for that short time but necessary for the account.

                  We have three small private pensions and a bit of interest but live off capital. We have nowhere near enough income to pay tax but understand we should still submit a nil return.

                  If anyone has actually registered and knows what paperwork will be required or has asked a fiscal agent to do it that info would be appreciated.

                    To become fiscally resident and obtain any Spanish tax advantages (which you can't do by just having the green residencia form) to which you are entitled you need to submit a tax return in Spain.

                    This involves either employing a fiscal representative, or try talking to your bank many of whom offer this service.

                    Or you can DIY via a visit to the tax office in Orihuela city - remember this is NOT the SUMA offices they only collect municipal taxes NOT income taxes.

                    If you are planning to pay taxes in Spain you get leave the UK system (ie you dont pay taxes twice under the Double Taxation Agreements) search the UK Gov Tax www sites for more information.

                      Thanks for the reply Rob. However, we know that we have to submit a tax return to become fiscally resident, and we are not worried about double taxation agreements for the purpose of this question. We are not liable to tax. We do not have enough income. We just need an answer to the question of whether we need the padron and the residencia to file the tax return.

                      We will probably pay someone to do it for us but we cannot get a definitive answer from anyone on the padron and residencia issue. If the fiscal people do not know the answer that worries me slightly.

                        OK - The answer is Yes you do - because they will only accept full time permanent residents filing the full tax returns as without those papers you are deemed non resident in the tax mans eyes and so other forms apply.

                        Which if you think about it - is fairly logical?

                          Yes it is logical to me which is why I asked the question as two offices who are supposed to know about submitting tax returns and registering foreign people for tax have told me no padron or residencia is necessary.

                          No wonder its so difficult to find people out here to trust.

                          I have asked one of our neighbours a spanish guy who works for the Elche National Police whether we need the padron to get the residencia from Elche and he didnt know!!

                            Went to renew my residencia in Torrevieja yesterday and they wanted a copy of my Padron. A person had his rejected as he did not have one.

                              If you live in Torrevieja you cannot get residencia in Elche any longer - it is either Torre or Alicante.

                              The rules regarding this keep changing as new ideas come along - ie to ensure people bothered with the padron they built it into the residencia process which some said was illegal as that process is supposed to be a national one!

                              Why do you not go to the new AMICS office in Torre and they will give you the definitive answer - not every policeman who works in Elche will be involved with that process and so he will not know.
