  • How do I legalise my swimming pool?

My swimming pool was not on my escitura and I have been told that I will have to sort this out before I can sell the property. Does anyone know the process and what is involved in legalising an existing swimming pool.

Do I need a licence from the Town Hall - any idea how much this costs?
Do I need to use a solicitor and notary for the legislation?

    Grateful for any help givem.

Yes and no! - You could sell the property without the pool being on the escritura but then it would be ignored for valuation and sale amount purposes because legally it does not exist.

To legalise it (assuming that is possible) apply to the town hall for the license retrospectively, will involve fees and maybe a fine, then return to the notary amend the escritura and re-register with the land registry. Could also involve paying more IBI (and back payments)

Suggest you get good legal advice and help, with all due respect can't see anyone getting through this without help..

I would imagine that most people who built a pool after buying a house don't have it on the excitura, not something you would think you need permission for although knowing Spain it could be possible.
However having one in this day and age won't make much difference to the valuation but will make it more attractive to sell.
I really don't think it would make any difference to the sale process as it is just a hole in the ground and knowing the system here would probably not be noted as something included in the sale anyway as there is not much chance of you taking it with you after completing.
I have a house with a pool and as far as I am aware the house has always had a pool since it was first built 20 years ago, around 10 years ago the house was reformed and extended and I have all the drawings, plans, licenses and permissions, there is no mention of a pool anywhere, someone from the townhall at some point must have inspected the start and finish of the project so if it was needed I would imagine the pool would be noted.

Spend the money registering it if it worries you but I don't think it will affect selling if you don't.

I also think if the pool is on the escritura you are liable for extra Suma.
