    Our community understand the section of the horizontal law which allows one vote against ie for community fees being shared and the motion falls.

    What we now have is issues regarding garden walls which externally to the property are community walls, wood fire chimneys, different colours of cotegrand, we are being told by our president that to allow these changes it is subject to a unanimous vote, if one vote against and amendments cannot happen, is this correct ?

    We also requested a majority voting system at our last AGM this year for other issues within the community, for this to take effect does it have to be unanimously voted in to become agreed ? or is this accepted to be agreed on a majority decision ?

    its splitting even further a divided community to the point people are not talking whilst others are holding secret meetings to discuss the next move,

    Horizontal law

    The Horizontal Property Law describes the necessary majorities for the approval of agreements depending on what its aim is.
    Unanimity is required to modify the Master Deeds, where the properties are described, as well as the community rules. However the requirement of having unanimity to approve the mentioned changes, can be altered if it is unanimously voted by the owners that only having the majority the change would be approved.
