    BBC and Sky deny transmission rights in Spain

    THE BBC told CB News this week that no company based in Spain has a licence to show its public service channels.

    They stated that it is illegal to rebroadcast these channels in Spain without a licence from them.

    The BBC and Sky have both told CB News that companies that do this are breaking copyright laws.

    A spokesman for the BBC explained this week that the BBC’s public service channels –BBC1, BBC2 and the digital channels – are produced for broadcast in the UK only.

    He added that although European law allows channels that are broadcast in an EEA (European Economic Area) country to be licensed for cable redistribution in another EEA country, the BBC only currently licenses cable redistribution in the Republic of Ireland, Belgium and the Netherlands.

    “The BBC’s public service channels are not licensed for broadcast in any other countries,” the spokesman added.

    “Our international news channel, BBC World News is distributed in Spain.

    “BBC Worldwide’s international general entertainment channel, BBC Prime, is licensed directly to individual subscribers in Spain but is not currently licensed to a cable, satellite or other platform.”

    But he added that cable operators in Spain could come to an agreement with the BBC, as they have done in the Benelux countries.
    He continued: “If a cable operator wishes to redistribute the BBC’s channels it must enter into a licence with the BBC and other underlying rights holders.

    “The BBC can choose whether or not to license the BBC’s public service channels for redistribution in this way.”

    BskyB has already stated that it is illegal to receive its programmes in Spain.

    A spokesman said: “We authorise the reception of Sky TV in the UK and Ireland only.

    “Our terms and conditions expressly prohibit reception elsewhere in Europe.”

    BBC Prime clients can use their own equipment to view English programmes with more information available at BBC Prime - select a country
    It is an encrypted channel and customers need to buy a subscription to receive a smart card which enables them to receive up to 50 channels with BBC Prime being just one of them.

    A BBC Prime spokesman added: “Live coverage or highlights of sporting events is not something that BBC Prime includes in its schedules.
    “We do not have international transmission rights to the action.
    “International rights to the pictures have to be bought on the open market and payment made for European or global transmission.
    “Often the international rights are held by a number of different channels with exclusivity clauses for their territory, and so are unavailable to us.”

    Also this week the Guardia Civil revealed that the investigation into Costa Blanca rebroadcasting company Telmicro Levante SL remains ongoing.

    A Guardia Civil spokesman in Alicante said: “We cannot give any information about the investigation.

    “The judge must establish when the investigation is finished and when we are allowed to give information.

    “Clients interested in getting information must go to Torrevieja’s court.
    “They can present a formal complaint if they have a contract signed with Telmicro and they feel the contract has been broken.

    “The judge would then decide whether the complaint is accepted or not and which crime if any the company might have committed.”

    Assuming I've heard right from Telmicro, their service from this point onwards will be completely legal - all channels fully and legally contracted here, I've been assured that NO unauthorised channels will be included in the service. Now which channels at the end of all this will be left I'm not sure, but I've had the service for years and been completely happy with them like you. I enjoy my Spanish TV and watch plenty of great series on there like CSI, Numb3rs etc, but am looking forward to my English TV again.

    I'm not paying for anything til I get a signal back on so am completely happy to wait. IF after that I don't like the servie then like Mikea, I'll look for another, but I defy any other company to be able to prove they have contracted channels.

    Spanish stations that I can get on my Digibox (27 stations). Teledeporte ,
    La 2 show plenty of football (Aston Villa v Liverpool at 5pm)
    MGM , Xtreme , Cinestar film channels (never found much to watch on these stations in the past )

    If we don't get BBC1,BBC2.ITV. CH4 and CH5 (the channels we really want) is it worth 20 euros per month just to watch the news and an occasional film of interest ????? (get those on my digibox in english)
    I get the feeling that they are going for quantity rather than quality !
    I hope I am wrong . Time will tell !
    What site do you find the listings for English football on TVE2 and Teledeporte? How are you finding out what game is on and when?

    Telmicro announcement today

    I live in the Almeria region and I am not receiving any channels as yet. Is anyone receiving channels in this area? I've tried to ring Telmicro on the number provided in their announcement and surprise, surprise, it's permanently engaged.

    Biased??? Of course I am! I am afraid to say that your comments are all incorrect and that perhaps you should do some homework on a subject before making incorrect comments.

    Mikea - I find your responses refreshing and straightforward. I have lived here for too many years now and the constant enquiries from many neighbours who depend on me does tend to wear me down. If what you propose is a 'runner' - a viable and legal alternative, then I am delighted to hear of it and shall watch this space and recommend your services.
    I have seen so many people conned out here it is outrageous.
    Perhaps you could extend your business and take over a lot more, builders, tradesmen, car salesmen, etc etc. I have always believed that honesty is the best policy so good luck with your endeavours.

    So buy a legitimate SKY viewing card in Spain using a Spanish address...No...it cannot be done.Why, ask yourself that!!!

    OK so purchase a SKY Card in the UK with the registered viewing address in the UK but used in another place...Check the Law and you will find that this is not a civil offence but rather a CRIMINAL OFFENCE...TV Licensing - Detection and Penalties

    and the Sky User Agreement is a contractual requirement under UK law which is passed to the TV Licensing Authority for regulatory compliance...which therefore transfers from civil to criminal law...

    Thank you for your comments...just to put you in the picture I and other colleagues are currently communicating with the Legal and Compliance departments of most of the major UK Linear Channel Operators, Programming Agents, Commissioning Agents and many others on a daily basis. This is on behalf of ELTEL MEDIA SL in plans to bring FULLY LEGAL UK TV to Spain via ELTEL.TV...and by fully legal we mean legal in all forms of transmission, licenses and content...

    if you miss corrie and eastenders, emmerdale or top gear , these progs are in brit box . dont be worried about search as i have done it with a google search . someone else mentioned it on this tread & and it is BRILL !!!!!!!!!!!!!!

    Best option is to get you own dish and receiver as things are not looking good and with the EEC applying pressure on the Spanish Goverment to enforce copyright Laws hence the recent activities.
    If the channels are contracted from the channels owners then there is nothing illegal about it at all. Please will you just confirm to everyone that you're not just trying to sell your services and admit that if a company CONTRACTS a channel IN SPAIN from THE OWNERS OF SAID CHANNEL that it is completely legal. Telmicro have already confirmed that they wil now only be broadcasting CONTRACTED channels therefore completely legal - correct? It seems you're more interested in putting people off one service and chasing them to another one that you happen to provide.
